Panama, August 2025 — At the 2025 National Congress of Accountants, our Partner, Attorney Javier Mitre, participated as a speaker in one of the event’s most notable sessions, focusing his presentation on the challenges arising from the implementation of Panama’s Tax Procedure Code (TPC) one year after its full entry into force.
In his presentation, titled “We Must Not Normalize Violations of Due Process in Tax Matters,” our partner issued a firm call for legal and institutional reflection in response to the concerning selective application of the TPC, as set forth in Law 76 of 2019.
He highlighted that, despite the code having been fully in effect since June 2024, certain administrative practices still ignore basic principles of the Panamanian legal system. These include the issuance of resolutions lacking clear legal basis, continued use of repealed regulations, failure to define the scope of tax audits, and flawed or absent evidentiary analysis.
“The lack of legal protection for taxpayers is a reality we cannot allow to become institutionalized,” emphasized Attorney Mitre. In this context, he reiterated that a modern and effective tax administration should not be judged solely by its revenue figures, but—more importantly—by its strict adherence to the legal framework and its respect for the fundamental rights of taxpayers.
